1. Nature and Purpose of the Platform

The Buddy Mentor platform (www.buddymentor.ai and associated mobile applications), operated by Vishesham Private Limited (hereinafter “Vishesham,” “we,” “us,” or “our”), is designed solely as an educational technology and mentorship platform aimed at facilitating skill development, professional growth, and career readiness among engineering students, fresh graduates, and industry professionals.

THE INFORMATION, CONTENT, COURSES, MENTORSHIP INPUTS, GUIDANCE, AND ALL OTHER MATERIALS AVAILABLE ON THE PLATFORM ARE PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. NOTHING ON THE PLATFORM CONSTITUTES OR SHOULD BE CONSTRUED AS PROFESSIONAL ADVICE OF ANY KIND, INCLUDING BUT NOT LIMITED TO LEGAL, FINANCIAL, MEDICAL, OR CAREER ADVICE. USERS SHOULD SEEK INDEPENDENT PROFESSIONAL ADVICE TAILORED TO THEIR SPECIFIC CIRCUMSTANCES BEFORE RELYING ON ANY INFORMATION OBTAINED FROM THE PLATFORM.

Buddy Mentor is an educational and mentorship platform, not a hiring agency, placement consultancy, university, accreditation body, or government authority. Access to the Platform, completion of any Course or programme, and receipt of any certificate, assessment report, or mentor recommendation does not and shall not be construed to:

1. Guarantee employment, placement, or career advancement;
2. Constitute admission to any educational institution;
3. Confer any official academic qualification, professional certification, or government-recognised credential;
4. Guarantee any specific learning outcome, skill acquisition, or examination result; or
5. Constitute an endorsement by any employer, industry body, or regulatory authority.

Results achieved by individual Users will vary depending on personal effort, prior knowledge, educational background, market conditions, industry dynamics, employer discretion, and other factors entirely beyond the control of Vishesham. Testimonials and success stories published on the Platform represent individual experiences and are not representative of typical outcomes.

3. Mentor Guidance

Guidance, feedback, recommendations, and information provided by Mentors on the Platform is based on their individual professional experience, knowledge, and perspective. Such guidance is strictly informational in nature and shall not be construed as a guarantee of any outcome, professional advice, or any form of warranty, express or implied. Vishesham does not represent, warrant, or guarantee the accuracy, completeness, or suitability of any guidance provided by a Mentor.

4. Accuracy of Content

While Vishesham makes reasonable efforts to ensure that the content published on the Platform is accurate and up-to-date, we do not warrant or represent that any content is free from errors, omissions, or inaccuracies. The fields of engineering, technology, and professional practice are rapidly evolving, and content may not always reflect the most current developments, standards, or practices. Users are advised to independently verify any information before relying upon it for any purpose.

5. Third-Party Links and Services

The Platform may contain hyperlinks to external websites, resources, or services operated by third parties. The inclusion of any such link does not imply endorsement, sponsorship, or affiliation by Vishesham. Furthermore, Vishesham does not control and shall not be responsible for the actions, decisions, or omissions of third parties, including but not limited to employers, clients, payment gateways, video hosting platforms, and content delivery networks.

PART II: LEGAL DISCLAIMER

6. Limitation of Legal Liability

To the fullest extent permitted by applicable law, Vishesham Private Limited, and its directors, officers, employees, agents, representatives, mentors, and affiliates expressly disclaim all liability for:

1. Any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or in connection with the use of, or inability to use, the Platform or its content;
2. Any loss of profits, revenue, data, goodwill, or business opportunity;

1. Any reliance placed upon the content, information, or guidance provided on the Platform;
2. Any interruption, suspension, or cessation of the Platform or any of its features; or
3. Any acts or omissions of third parties, including payment service providers, employers, or technology service providers.

The aggregate liability of Vishesham for any claim arising out of or relating to the Platform, however arising (whether in contract, tort, negligence, or otherwise), shall not exceed eighty percent (80%) of the total fees paid by the User to Vishesham in respect of the specific Course or service giving rise to the claim, after deducting applicable bank charges, payment gateway fees, and other external service charges.

7. No Professional or Regulatory Advice

While the Platform includes content relating to engineering professional practices, the information provided therein is strictly educational in nature. It does not constitute advice from a licensed professional, regulatory body, or recognised institution. Users engaged in professional practice are advised to consult qualified professionals and comply with all applicable professional standards, codes of conduct, and regulatory requirements in their respective jurisdictions.

Similarly, Memoirs (physical merchandise) sold through the Platform are consumer goods offered on a “as-is” and “as-available” basis, and any reference to such goods is not intended to constitute any professional recommendation or endorsement.

8. Warranty Disclaimer

THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, VISHESHAM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE ACCESS.

PART III: USER RESPONSIBILITY

9. User’s Own Responsibility

Each User accessing or using the Platform assumes full personal responsibility for their interactions with the Platform, its content, and other Users. By accessing the Platform, you acknowledge and agree that:

1. You shall exercise independent judgment and conduct your own due diligence before relying on any information, guidance, or content available on the Platform;

1. You shall not hold Vishesham, its Mentors, or any associated personnel responsible for decisions made on the basis of Platform content;
2. You are solely responsible for the User-Generated Content you post or upload on the Platform, including Reviews, Tech Diary entries, Drill submissions, and Q&A responses;
3. Any User-Generated Content posted by you shall comply with all applicable laws, shall not infringe the intellectual property or other rights of any third party, and shall not be defamatory, obscene, or otherwise unlawful; and
4. Vishesham accepts no liability for any User-Generated Content, including any claims arising therefrom.

10. Responsible Use of the Platform

Users are required to use the Platform in a responsible, lawful, and ethical manner. Any misuse of the Platform, including but not limited to unauthorised reproduction of content, plagiarism, sharing of course materials, or circumvention of security measures, shall be the sole responsibility of the User and may result in immediate termination of access and civil or criminal action.

11. Memoirs – Physical Merchandise

Physical merchandise (Memoirs) sold through the Platform, including but not limited to cups, T-shirts, and badges, are third-party manufactured goods offered as promotional or commemorative items. Vishesham makes no representation or warranty regarding the quality, fitness, or durability of such goods beyond the terms of the applicable purchase. Users are advised to review the product descriptions carefully prior to purchase. Vishesham’s liability in respect of Memoirs shall be limited to the purchase price paid.

12. Specific Product Disclaimer

In accordance with the nature of the Platform, the following specific disclaimers apply:

1. Buddy Mentor is an educational and mentorship platform, not a hiring agency, university, or government body.
2. Results vary by learner effort, background, market conditions, and employer decisions.
3. Mentor guidance is informational and based on experience, not a guarantee of success or any specific outcome.
4. Vishesham does not control third-party actions, including those of employers, clients, payment gateways, or video and content delivery services.
5. User-Generated Content remains the sole responsibility of the User who posted it.
6. Memoirs are sold as bought-out physical items; educational content is provided on an access basis and does not constitute ownership of intellectual property.

13. Governing Law

This Disclaimer Policy shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 (as amended, including IT Rules, 2021), the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019 (read with E-

Commerce Rules, 2020), the Copyright Act, 1957, and the Indian Contract Act, 1872. Any disputes arising in connection with this Disclaimer Policy shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.
